Terms of Service
Effective April 2026Introduction
These Terms of Service govern your access to and use of SilkCat House services, including our guest intelligence platform, pre-arrival briefing system, and all associated software and communications. By engaging with SilkCat House, you agree to be bound by these terms in their entirety.
SilkCat House operates by private introduction only. Access to our platform is granted at our sole discretion following a formal introduction and onboarding process. These terms apply from the moment of first access.
Use of Services
Our services are provided exclusively to licensed hospitality operators including restaurants, fine dining establishments, and their authorised staff. Use of our platform for any purpose other than the management of guest relationships and dining intelligence is strictly prohibited.
You agree not to reverse engineer, resell, sublicense, or otherwise distribute any component of the SilkCat House platform. All system outputs, including guest briefings, AI-generated copy, and wine pairing recommendations, are for internal operational use only.
Guest Data and Privacy
SilkCat House processes guest data on behalf of our partner restaurants in accordance with applicable data protection legislation. As a data processor, we act only on documented instructions from the data controller, which is the restaurant operator in each case.
Partner operators are responsible for ensuring that guest data shared with SilkCat House has been collected lawfully and that appropriate consent or legitimate interest grounds exist for its processing. We do not sell or share guest data with any third party outside of the agreed service scope.
Intellectual Property
All technology, software, algorithms, prompt architectures, and system designs forming part of the SilkCat House platform are the exclusive intellectual property of SilkCat House. Nothing in these terms grants you any ownership interest in any part of the platform.
Content generated by the platform on behalf of your restaurant, including guest briefings and menu copy, is licensed to you for use within your operation. You may not reproduce or distribute this content externally without prior written consent.
Limitation of Liability
SilkCat House shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our services, even if we have been advised of the possibility of such damages.
Our total liability in connection with any claim arising from these terms shall not exceed the total fees paid by you to SilkCat House in the twelve months preceding the claim.
Termination
Either party may terminate access to the SilkCat House platform with thirty days written notice. We reserve the right to suspend access immediately in the event of a material breach of these terms, including unauthorised use of guest data or misuse of system outputs.
Upon termination, all guest data held by SilkCat House on your behalf will be returned or securely deleted in accordance with our data retention policy and applicable law.
Governing Law
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
